Florida alimony basics
Need, ability to pay, and the length of the marriage
Alimony in Florida starts with two questions: does one spouse have an actual need for support, and does the other have the ability to pay? The length of the marriage, each spouse’s income and earning ability, and the standard of living established during the marriage all play a role.
In 2023, Florida eliminated permanent alimony and set new limits on how long durational alimony may last.
Types of alimony in Florida
- Temporary — support while the divorce is pending
- Bridge-the-gap — short-term help with transition, up to two years
- Rehabilitative — support tied to a specific plan for education or training, up to five years
- Durational — support for a set period tied to the length of the marriage
