The criteria
What makes a Florida divorce uncontested?
In general, a divorce can proceed as uncontested when:
- At least one spouse has lived in Florida for six months before filing
- You agree on dividing property and debts
- You agree on alimony — or that none will be paid
- If you have minor children, you agree on a parenting plan and child support
- Your spouse is willing to sign the agreement and cooperate with the filing
Things that can complicate it
When it may not be uncontested
- Significant disagreement over the house, retirement, or a business
- One spouse can’t be located or won’t participate
- Concerns about domestic violence or safety
- Suspected hidden assets or incomplete financial disclosure
- Disputes over time-sharing, relocation, or child support
If any of these apply, a free assessment is the right next step. We’ll tell you honestly whether a flat-fee approach makes sense.
