Health Care Directives in Florida

Make sure the people you trust can speak for you — and that your wishes about medical care are known — if you can’t speak for yourself.

Your health care documents

Three documents that work together

Designation of Health Care Surrogate

Names the person who can make medical decisions for you if you can’t, and can let them act sooner if you choose.

Living Will

States your wishes about life-prolonging procedures if you have a terminal, end-stage, or persistent vegetative condition.

HIPAA Authorization

Allows doctors and hospitals to share information with the people you choose.

Why it matters

Clarity for your family in a hard moment

Without directives, doctors may turn to family members in an order set by Florida law — which may not be the person you would choose — and loved ones may disagree about what you would have wanted. Clear documents spare your family those decisions.

Pre-need guardian designation

Accord plans also include a pre-need guardian designation, when applicable, so that if a court ever needs to appoint a guardian for you, it knows who you would want.

Questions

Health Care Directives FAQs

A health care surrogate designation names a person to make medical decisions for you. A living will states your own wishes about life-prolonging procedures in specific end-of-life situations. Most people have both.

Someone who knows your values, can handle stress, and will be reachable when needed. You should also name an alternate.

No. A Do Not Resuscitate Order is a medical form signed by your physician. A living will is a legal document expressing your wishes. Talk with your doctor about whether a DNRO is appropriate.

Florida generally honors advance directives validly executed in another state. Many new residents update to Florida forms so hospitals here recognize them easily.

Published flat fees apply to standard Florida estate-planning matters. Advanced planning, complex asset structures, and other matters outside the stated package scope are quoted separately after attorney review. Government recording charges are separate.
