The basics
What is an uncontested divorce?
A divorce is uncontested when you and your spouse agree on all of the material issues — how to divide property and debts, whether alimony will be paid, and, if you have minor children, a parenting plan and child support.
Florida is a no-fault state: the court only needs to find that the marriage is irretrievably broken. At least one spouse must have lived in Florida for six months before filing.
Agreeing doesn’t mean the legal work is simple. The agreement still has to be complete, correctly drafted, and accepted by the court — and that is where an experienced attorney matters.
An uncontested divorce may be right for you if…
- You both agree to work amicably through the process
- You agree on how to divide property and debts
- You agree on alimony — or that none will be paid
- You agree on a parenting plan and child support, if you have children
- Your spouse is willing to sign and cooperate with the paperwork
