Divorce With Children

End the marriage. Protect the family. Plan what comes next. An experienced attorney turns your agreement into a clear, workable parenting plan — for one flat fee.

We help parents in Clermont and Oviedo put together parenting plans, time-sharing schedules and child support that work for their families.

What Florida requires

An agreed divorce with children has more moving parts

When you have minor children, Florida requires more than a settlement agreement. The court must approve a parenting plan and child support that meet Florida’s legal requirements and serve your children’s best interests.

Built for real life

Vague schedules are one of the most common reasons parents end up back in court. We draft specific, practical terms — exchanges, holidays, school breaks, travel, and communication — so everyone knows what to expect.

The process

How it works

STEP 1Determine fit

A short questionnaire or free 15-minute assessment confirms your divorce qualifies as uncontested, including agreement on the children.

STEP 2Fee agreement

You receive a written flat-fee agreement stating the package, inclusions, and exclusions.

STEP 3Strategy session

Your attorney talks with you by phone or video about your family’s schedule, needs, and goals — and anything that could cause problems later.

STEP 4Information gathering

You provide financial information, the children’s schedules, and required documents through a guided checklist.

STEP 5Attorney drafting

Your attorney prepares the petition, marital settlement agreement, customized parenting plan, and guideline child-support calculations.

STEP 6Client review

You review everything, ask questions, and request revisions within your package.

STEP 7Filing & parenting course

Documents are signed and filed with the court, and each parent completes the required parent education course. Florida requires at least 20 days after filing before a final judgment.

STEP 8Final hearing

Your attorney represents you at the brief final hearing where the judge reviews your agreement and parenting plan.

STEP 9Divorce decree

The court enters the final judgment of dissolution, including your parenting plan — and your divorce is complete.

Questions

Divorce With Children FAQs

Yes. You will need an agreed parenting plan, child support calculated under Florida’s guidelines, and each parent must complete a parent education course. When those pieces are agreed, the divorce can proceed as uncontested.

Florida uses statutory guidelines based on both parents’ incomes, the number of children, health insurance and child-care costs, and the number of overnights each parent has. Your attorney prepares the guideline calculation as part of the package.

Since 2023, Florida law presumes that equal time-sharing is in a child’s best interests, but parents can agree to a different schedule and the presumption can be overcome with evidence. Your parenting plan reflects what works for your family.

A brief final hearing is typically required. Your attorney represents you at the hearing, where the judge reviews the agreement and parenting plan.

If the disagreement is narrow, Almost Agreed™ may help. If you disagree on major parenting issues, schedule a free assessment so we can discuss your options honestly.
