What a will does

Your wishes, in writing, the way Florida requires

A will is the foundation of most estate plans. It tells the court and your family what you want — and who you trust to carry it out.

Florida signing requirements

  • You must sign at the end of the will.
  • Two witnesses must sign in your presence and in the presence of each other.
  • A self-proving affidavit, signed before a notary, makes the will easier to admit to probate later.
  • Handwritten wills are not valid in Florida unless they are properly witnessed.

Every Accord plan includes detailed signing and execution instructions so your will is signed correctly.

Good to know

What a will doesn’t do

A will doesn’t avoid probate — it guides it. And it doesn’t control assets that pass another way, such as life insurance and retirement accounts with named beneficiaries, jointly owned property, or accounts with payable-on-death designations.

Florida’s homestead rules can also limit how your home may be left if you are survived by a spouse or minor child. That’s why we review your home, title, and beneficiary designations as part of the plan.

Wondering about a trust?

If avoiding probate or keeping your affairs private matters to you, a revocable living trust may be the better foundation.

Questions

Florida will FAQs

Florida’s intestacy laws decide who inherits based on family relationships, which may not match your wishes. The court appoints the person who administers your estate, and you lose the chance to name a guardian for your children.

No. A will directs how probate is handled but does not avoid it. Assets held in a funded revocable trust, or that pass by beneficiary designation or joint ownership, generally pass outside probate.

Yes. Florida law generally treats provisions for a former spouse as revoked after divorce, but that doesn’t name who takes their place, and other documents and beneficiary designations may still need updating.

An online service can produce a document, but no one reviews your family, your home, or your beneficiary designations — and signing mistakes can invalidate the will. With Accord, an attorney drafts your plan and explains exactly how to sign it.

A simple will is $495. Complete will-based estate plans, including powers of attorney and health care directives, start at $895 for an individual and $1,395 for a couple.
